The Fashion Booth is a specialist designer and creator of bespoke garments and possum fur products using sustainable locally sourced natural fibre where possible. We can provide a visiting tailor service for our items and can meet you in our workroom premises located in Roxburgh, Central Otago, NZ, by appointment only for those who prefer a face-to-face personalized service. The Fashion Booth welcomes customer contact via phone or email to discuss any aspect of a purchase or potential purchase.
All purchases of goods and services from us are subject to the terms and conditions set out below.
Interpretation
In these Terms and Conditions (“Terms”), the following words and phrases shall have the following meanings:
“You, your”
means the person, firm or company who purchases Goods from Us.
“We, Us, Our”
means The Fashion Booth. (TFB)
“Contract”
means the contract between Us and You which shall be deemed to incorporate these Terms;
“Goods”
means any goods agreed in the Contract to be supplied by Us to the Buyer;(You)
“Shipping information”
means the place to which the Goods are to be delivered.
The Contract:
The Contract shall be considered the contract on agreement by You when a purchase either online or via the phone is paid for in full. Written confirmation will be supplied by TFB before any commencement of work on Your item/s. No terms and conditions contained in any confirmation of order, purchase order or other document provided by You or verbally, will form part of the Contract unless in written confirmation in agreeance between You and TFB.
Price and Payment:
- The price for the Goods shall, be the price identified by Us to You and set out in at the time of the initial engagement online or via phone and clarified/confirmed in writing via email. Indicative prices can be seen on our website www.thefashionbooth.co.nz
The price for the Goods shall be displayed inclusive of GST and any costs of shipping and insurance within NZ. We reserve the right to make additional charges when agreed to make alterations to an item on Your request either at time of purchase or after You have received the shipped goods. We reserve the right to make an additional charge for last minute cancelled / postponed tailor service at a rate of $100 per day.
- Payment for items shall be made in full and upon the order for the Goods being placed.
- Payment shall not be deemed to have occurred until We have received cleared funds.
- A confirmation email will be sent once payment is completed.
- Additional charges will apply for alterations agreed upon, to any garment or possum fur product.
- Once full payment is received TFB will commence production of Your goods if a buy now option is not available.
Cancellation Policy:
As all orders are made to Your measurements, styles, and specifications; or otherwise modified to your requirements; you may only cancel your order by agreement in writing by TFB if production has not begun.
To cancel any order, You must inform Us of such cancellation in writing and await full acceptance from TFB.
Our Cancellation Charges are found below based on the work and time undertaken at certain times throughout the process:
1. Cancellation After Initial engagement and placement of order. 50% of order value.
2. Cancellation After any manufacturing process has begun of Your order, 100% of order value.
Delivery/Shipping:
We offer a bespoke tailoring service. As such, You recognize that the time that it will take Us to make the Goods will vary and be dependent upon such matters as the availability of textile, buttons, shoulder pad and Your ability to attend fittings if requested by You. TFB is not responsible for delays but is responsible to keep You updated on any delays that may occur. We will be responsible to keep You updated with the anticipated date of delivery of the goods but unless We agree specifically in writing, time for delivery shall not be of the essence. TFB will not take responsibility for You providing incorrect shipping details or You arranging for the goods to be delivered with no signature required.
Risk in and Ownership of the Goods
Risk in the Goods shall normally pass to You on delivery unless you have asked Us to hold onto goods on Your behalf in which case risk passes to You at the point that you instruct Us to hold them for You. However, ownership in the Goods shall not pass to You until We have received in full, cleared funds of all sums due to Us in respect of the Goods
Warranties
We warrant that the Goods are provided to the best possible quality. If You wish to make a claim under this warranty, You shall give written notice to Us within 14 days from the delivery date, on discovery of the defect and give Us a reasonable opportunity to inspect the Goods. Our liability under the warranty shall be limited to repairing or replacing the Goods in question or refunding the price of such Goods.
Shipping will be reimbursed by Us if the return goods are accepted under the manufacturing or textile defective product.
What we do not cover under warranty
We can give no assurance or warranty that textile or Possum fur used in manufacturing the Goods will be identical in colour, shade or texture with any item you select, however TFB will offer to send You a sample of the colour of the textile You choose before purchase occurs. Colours of textile and Possum fur may vary according to screen display on individual devices.
- Any imperfections of possum fur where it is of natural occurrence, fur length or shade.
- An item that has been worn or used in any way.
- Goods that You have not followed care labels.
- Goods that You have failed to notify TFB in writing or the TFB accepting in writing of any defect of textile or manufacturing quality.
- Shipping returns for uncovered warranty goods
- Shipping returns for extra agreed individual tailoring.
- You providing incorrect shipping details
- Insurance on Your goods when You have authorized a non-signature on delivery with the shipping company.
Returns:
Since the process that we follow, at Your instruction, is one involving Your careful consideration and selection of textile cloth and design, We shall therefore only accept returns for Goods which are defective. Shipping insurance will cover damage during shipping. It is Your responsibility to check the goods thoroughly when received. All goods returned to Us will only be accepted subject to the following terms and conditions: –
- TFB must be notified in writing of the defect within 14 days from date of delivery.
- Returned Goods must be returned within 30 days
- No refund or replacement can be made against Goods which cannot be confirmed as coming from You as the person who is returning them.
- Goods must be returned complete, including where appropriate all packaging in an acceptable condition. We will refund carriage costs if the fault is within manufacturing.
- Returned Goods must be returned to Our address stated on the accompanying invoice. We cannot be responsible for any Goods which are returned but lost in transit.
Limitation Of Liabilities:
Our liability in contract, tort or otherwise arising out of the subject matter of the Contract shall not exceed the original price of the goods. Under no circumstances will We be liable to You for any consequential, indirect, or economic loss.
Data Protection and Privacy:
Where we collect Your personal data, it will only be used in accordance with the NZ Privacy Act 1993. We shall not share it with any third party. We may use this data to contact You for any future marketing, advertising, and promotional purposes. You have the right to ask us for a copy of the information We hold on You for which We may charge a small fee to cover TFB time related to.
You may find links to third party websites on Our website. These websites are generally and typically subject to their own privacy policies which You should check. We do not accept any responsibility or liability for those websites.
Force Majeure:
If We are subject to circumstances outside Our reasonable control, including but not limited to war, insurrection, riot, fire, industrial disputes, civil commotion, terrorism, pandemics or natural disasters regarded as an act of God, We shall notify You and such notification shall have the effect of suspending Our obligations under this Contract until We notify You that the event of Force Majeure no longer applies.
General:
TFB guarantees all possum skins collected are done so in accordance with the human pest control legislative requirements. NZ possum is regarded as a pest.
